Market Cube’s mission is to provide Panelists with survey opportunities that provide feedback to businesses in exchange for incentives. Central to this mission is our commitment to be transparent about the data we collect about you, how it is used and with whom it is shared.

This Privacy Policy applies when you use our Services (described below). We offer our users choices about the data we collect, use and share as described in this Privacy Policy.


Introduction

Our registered users (‘Panelists’) share their profile information, take market research surveys and get rewarded. Content and data on some of our Services is visible to Panelists and non-Panelists (e.g. Visitors to our Services, and our Clients). See Section 3.1 for details.

We are an online sample, survey and research company. Connection and relationship is at the heart of our business.
Getting to know you is just as important as getting to know your audience.

Our Privacy Policy applies to any Panelist, Client or Visitor to our Services.


Services

This Privacy Policy applies to market cube.com, univoxcommunity.com, specpancommunity.com, surveyhub.com, rankingcube.com, Univox App, and other Market Cube-related sites, apps, communications and services (“Services”), but excluding services that state that they are offered under a different privacy policy.

Data Controllers and Contracting Parties

Market Cube LLC (‘Market Cube, USA’) is the Controller of your personal data provided to, or collected by or for, or processed in connection with our Services - you are entering into the User Agreement with Market Cube, USA.


As a Panelist or Visitor to our Services, the collection, use and sharing of your personal data is subject to this Privacy Policy (which includes our

Cookie Policy and other documents referenced in this Privacy Policy) and updates.


Change

Market Cube (“we” or “us”) can modify this Privacy Policy, and if we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. If you object to any changes, you may close your account.

You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and sharing of your personal data is subject to the updated Privacy Policy.

Changes to the Privacy Policy apply to your use of our Services after the “effective date.”


1. Data We Collect


1.1 Data You Provide To Us


Registration

To create an account you need to provide data including your name, gender, date of birth, email address, postal address, and a password.

You provide data to create an account with us.


Profile

We collect personal data from you when you provide it to our Services, such as when you fill out a form (e.g., with demographic data) or respond to a survey.

You have choices about the information on your profile, such as your education, work experience, and further profile information. You don’t have to provide additional information on your profile; however, profile information helps you to get more from our Services, including more surveys and a higher chance of completing surveys. Some personal data sharing is required in order to complete surveys and earn an incentive.

Please do not post or add personal data to your profile that you would not want to be available to others.


Sensitive personal data

Some of our surveys may require you to provide personal data that is regarded as sensitive. Your consent to provide us with your sensitive personal data will make you eligible to take additional client surveys.

The following types of personal data are generally regarded to be ‘sensitive’:

You give us your personal data when you create your profile (a complete profile helps you get the most from our Services).


1.2 Data From Others


Partners

We receive personal data about you when you use the services of our customers and partners, such as market research agencies, consumer packaged goods companies, and others.

Customers and partners may provide data to us.


1.3 Service Use


We log usage data when you visit or otherwise use our Services, including our sites, app and platform technology such as when you view or click on content (e.g. polls, participate in the forum), install or update one of our mobile apps. We use log-ins, cookies, device information and internet protocol (‘IP’) addresses to identify you and log your use.

What types of cookies does Market Cube use?

We use two types: persistent cookies and session cookies. A persistent cookie helps us recognize you as an existing user, so it’s easier to interact with or return to our Services without signing in again. After you sign in, a persistent cookie stays in your browser and will be read by Market Cube when you return to one of our sites or a partner site that uses our services. Session cookies only last for as long as the session (usually the current visit to a website or a browser session).


What are cookies used for?

Cookies can be used to recognize you when you visit Market Cube Services, remember your preferences, and give you a personalized experience that’s in line with your settings. Cookies also make your interactions with our Services faster and more secure.

For example, a cookie tells the web server that you have returned to a specific page. If you personalize Univox Community pages, or register with Univox Community site or services, a cookie helps Univox Community to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same Univox Community Web site, the information you previously provided can be retrieved, so you can easily use the Univox Community features that you customized.

Cookies are also used for authentication, security, to manage your preferences and for performance analytics.

1.5 Your Device and Location


When you visit or leave our Services (including our plugins or cookies or similar technology on the sites of others), we receive the URL of both the site you came from and the one you go to next. We also get information about your IP address, proxy server, operating system, web browser and add-ons, device identifier and features, and/or ISP or your mobile carrier. If you use our Services from a mobile device, that device will send us data about your location based on your phone settings. We will ask you to opt-in before we use GPS or other tools to identify your precise location.

We receive data from your devices and networks, including location data.

We receive information about your visits and interaction with services provided by others when you visit others’ services that include our cookies or similar technologies.

2. How We Use Your Data


How we use your personal data will depend on which Services you use, how you use those Services and the choices you make in your settings. 2.1 Services

Take Surveys

Our Services allow you to provide input to businesses so they can customize their offerings, introduce new products, and otherwise influence the marketplace. In exchange, you will earn rewards for each completed survey, which can eventually be redeemed.

We will use data about you (such as your profile) to better match you to survey opportunities.

Our Services help you earn rewards by using your time to give feedback to businesses that need it.


2.2 Communications


We will contact you through email, mobile phone, notices posted on our websites or apps, messages to your inbox, and other ways through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security, or other service-related issues. We also send messages about how to use the Services, network updates, and reminders. You may change your communication preferences . at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices.

We contact you with regard to our Services. We offer you options to control what messages you receive and how often you receive some types of messages.


2.3 Marketing


We use data and content about Panelists for invitations and communications promoting panelist and network growth, engagement and our Services

We promote our Services to you and others.


2.4 Developing Services and Research


Service Development

We use data, including public feedback, to conduct research and development for the further development of our Services in order to provide you and others with a better, more intuitive and personalized experience, drive Panelist growth and engagement on our Services, and help connect Panelists to survey opportunities.


Polls

Polls are conducted by us and others through our Services. Participating in polls is optional. You also have choices about the information you provide.

We develop our Services and conduct research.


2.5 Customer Support


We use the data (which can include your communications) to investigate, respond to and resolve complaints and Service issues (e.g. bugs).

We use data to help you and fix problems.


2.6 Aggregate Insights


We use your data to produce and share aggregated insights that do not identify you. For example we may use your data to generate statistics about our Panelists, their profession or industry, to calculate ad impressions served or clicked on, or to publish visitor demographics for a Service or demographic workforce insights.

We use data to generate aggregate insights.


2.7 Security and Investigations


We use your data (including your communications) if we think it’s necessary for security purposes or to investigate possible fraud or other violations of our User Agreement or this Privacy Policy and/or attempts to harm our Panelists, Clients or Visitors.

3. How We Share Information


3.1 Our Services


Profile


Your profile is fully visible to customers of our Services (i.e. our Clients).

Additionally, posts on the forum are also visible to others (e.g. Visitors to our Services).

Any data that you include on your profile and any content you post or social action (e.g. likes, follows, comments, shares) you take on our Services may be seen by others.


3.2 Related Services


We will share your personal data with our Clients to provide and develop our Services. We may combine information internally across the different Services covered by this Privacy Policy to help our Services be more relevant and useful to you and our Clients. For example, SampleCube will recommend better content to you based on your PanelCube profile, and we can personalize your survey recommendations based on your household income, because we are able to identify you across different Services using cookies or similar technologies.

We share your data across our different Services and Market Cube-affiliated entities.


3.3 Service Providers


We use others to help us provide our Services (e.g. maintenance, analysis, audit, payments, fraud detection, marketing and development). They will have access to your information as reasonably necessary to perform these tasks on our behalf and are obligated not to disclose or use it for other purposes.

We may use others to help us with our Services.


3.4 Legal Disclosures


It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to:

(1) Investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies

(2) Enforce our agreements with you

(3) Investigate and defend ourselves against any third-party claims or allegations

(4) Protect the security or integrity of our Service (such as by sharing with companies facing similar threats), or

(5) Exercise or protect the rights and safety of Market Cube, our Panelists, personnel, or others.


We attempt to notify Panelists about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

We may need to share your data when we believe it’s required by law or to help protect the rights and safety of you, us or others.


3.5 Change in Control or Sale


We can also share your personal data as part of a sale, merger or change in control, or in preparation for any of these events. Any other entity which buys us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Policy unless you agree otherwise.

We may share your data when our business is sold to others, but it must continue to be used in accordance with this Privacy Policy.


4. Your Choices & Obligations


4.1 Data Retention


We retain your personal data while your account is in existence or as needed to provide you Services. This includes data you or others provided to us and data generated or inferred from your use of our Services. Even if you only use our Services for a short period, we will retain your information and keep your profile open until you decide to close your account. In some cases we choose to retain certain information (e.g. number of entrants to a survey) in a de personalized or aggregated form.

We keep most of your personal data for as long as your account is open.


4.2 Rights to Access and Control Your Personal Data


We provide many choices about the collection and use of your data, including deleting or correcting data you include in your profile. We offer you settings to control and manage the personal data we have about you, as follows:

Change or Correct Data: You can edit some of your personal data through your account. You can also ask us to change, update or fix your data in certain cases, particularly if it’s inaccurate.

Delete Data: You can ask us to erase or delete all or some of your personal data (e.g. if it is no longer necessary to provide Services to you).

Object to, or Limit or Restrict, Use of Data: You can ask us to stop using all or some of your personal data (e.g. if we have no legal right to keep using it) or to limit our use of it (e.g. if your personal data is inaccurate or unlawfully held).

Right to Access and/or Take Your Data: You can ask us for a copy of your personal data and can ask for a copy of personal data you provided in machine readable form.

As a resident of the European Union, you also have the right to file a complaint with your local Supervisory Authority. You can find the contact details here.

You have many choices about how your data is collected and used. You can access or delete your personal data.


4.3 Account Closure


If you choose to close your Market Cube account, your personal data will generally stop being visible to others on our Services within 72 hours. We generally delete closed account information within 30 days of account closure, except as noted below.

We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations (including law enforcement requests), meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement or fulfill your request to “unsubscribe” from further messages from us. We will retain de-personalized information after your account has been closed.

Information you have shared via completed surveys will continue to be available to our Clients after you have closed your account or deleted the information from your own profile or mailbox. Further, we do not control data that other users may have copied out of our Services. Groups content and ratings or review content associated with closed accounts will show an unknown user as the source. Your profile may continue to be displayed in the services of others (e.g. search engine results) until they refresh their cache.

We keep some of your data even after you close your account.


5. Other Important Information


5.1 Security


We implement security safeguards designed to protect your data, such as HTTPS. We regularly monitor our systems for possible vulnerabilities and attacks. However, we cannot warrant the security of any information that you send us. There is no guarantee that data may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

We monitor for and try to prevent security breaches.


5.2 Cross-Border Data Transfers


We process data both inside and outside of the United States and rely on legally provided mechanisms to lawfully transfer data across borders. Countries where we process data may have laws which are different, and potentially not as protective, as the laws of your own country. To ensure that your personal data is adequately protected when transferred outside your country, we adhere to the requirements prescribed by these mechanisms.

Market Cube's services require by their nature for data to flow from the European Union (EU) to Clients, suppliers and data processors both inside and outside the EU. To ensure that EU personal data is adequately protected when transferred outside the EU, the General Data Protection Regulation (GDPR) mandates that such transfers take place using certain legal mechanisms described here.

In many cases, we will use European Commission-approved Standard Contractual Clauses or equivalent as a legal mechanism for data transfers out of the EU. These clauses are contractual commitments between parties transferring personal data (for example, between Market Cube LLC and its Clients, suppliers or data processors outside the EU), binding them to protect the privacy and security of the data.

Univox Community may share your personal information and/or social-demographic information, including, without limitation, a unique identification number (“UID”), postal code, gender, marital status, education, ethnicity/race (where permitted by applicable law), employment related information, and non-personally identifiable information on household members, with third party sample/market research companies (individually each a “Third Party MR Company” and collectively the “Third Party MR Companies”) for the following purposes:
1. Identifying client survey opportunities that you may be eligible for through the Third Party MR Companies. And
2.Disclosing such data elements to clients of the Third Party MR Companies for audience measurement services. And
3. Appending such data elements to completed client surveys and delivering the appended survey data to clients of the Third Party MR Company(ies) for analytical or research purposes; and
4. Other uses as set forth in their privacy policy.
If you are eligible for a client survey opportunity offered through a Third Party MR Company, the Third Party MR Company will provide your unique identification number and a survey link to us and we will invite you to participate in the client survey through email. We will not share your name, email address, or phone number with the Third Party MR Companies. In connection with the sharing of your information with a Third Party MR Company, your information may be transferred and stored outside of your country of residence, including, without limitation, in the United States, and by agreeing to this privacy policy you are agreeing to the processing and exportation of your personal information as set forth in this Section. Please note that Market Cube is responsible for managing all opt-out requests. Your participation in such survey opportunities does not entitle you to any benefits offered by, or membership with, the Third Party MR Companies.
We have partnered with Survey Sampling International, LLC (“SSI”) and Peanut Labs, Inc. (“PL”) to provide you with additional survey opportunities and to earn our rewards. In connection with this partnership, we will pass certain personal data and social/demographic information to these parties for use in connection with the purposes set forth in their privacy policy. Note: Data centers storing Panelists' information are currently located in the United States.

5.3 Lawful Bases for Processing


We will only collect and process personal data about you where we have lawful bases. Lawful bases include consent (where you have given consent), contract (where processing is necessary for the performance of a contract with you e.g. to deliver the Market Cube Services you have requested) and ‘legitimate interests’.


Legitimate interests

We may process your personal data for the purposes of our legitimate interests or for the legitimate interests of third parties (e.g, our Clients), provided that such processing shall not outweigh your rights and freedoms. For example, we may process your personal data to:

(1) Protect you, us, or others from threats (such as security threats or fraud)

(2) Comply with laws that apply to us

(3) Enable or administer our business, such as for quality control, consolidated reporting, and customer service

(4) Manage corporate transactions, such as mergers or acquisitions

(5) Understand and improve our business or customer relationships generally

(6) Enable us, Panelists, and Visitors to connect with each other, express opinions, exchange information, and conduct business.

Where we rely on your consent to process personal data, you have the right to withdraw or decline your consent at any time and where we rely on legitimate interests, you have the right to object.

We have lawful bases to collect, use and share data about you. You have choices about our use of your data.

6 Your Consent


As Controller of your personal data, Market Cube LLC seeks your consent for the use your personal data. Please note that in order to make surveys available to you, your personal data is shared with our suppliers and Clients, who may seek additional information (including additional personal data) from you. Providing such additional information is optional.

Please let us have your consent to collect and use your personal data.

At any time, you can withdraw consent you have provided by going to settings.


User Agreement


Agreement between user and univox community

The Univox Community Web Site is comprised of various Web pages operated by Univox Community.
The Univox Community Web Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Univox Community Web Site constitutes your agreement to all such terms, conditions, and notices.
You acknowledge that you have read our “Privacy Policy” and understand that it sets forth how we will collect, store, and use your Personal Data. If you do not agree with our Privacy Policy, then you must stop using the Services immediately.



Modification of these terms of use

Univox Community reserves the right to change the terms, conditions, and notices under which the Univox Community Web Site is offered, including but not limited to the charges associated with the use of the Univox Community Web Site.

No unlawful or prohibited use

As a condition of your use of the Univox Community Web Site, you warrant to Univox Community that you will not use the Univox Community Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Univox Community Web Site in any manner which could damage, disable, overburden, or impair the Univox Community Web Site or interfere with any other party's use and enjoyment of the Univox Community Web Site. Conduct or forward surveys, contests, pyramid schemes or chain letters. Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner. Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded. Restrict or inhibit any other user from using and enjoying the Communication Services. Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service. Harvest or otherwise collect information about others, including e-mail addresses, without their consent. Violate any applicable laws or regulations.

Univox Community has no obligation to monitor the Communication Services. However, Univox Community reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Univox Community reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Univox Community reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Univox Community's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Univox Community does not control or endorse the content, messages or information found in any Communication Service and, therefore, Univox Community specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Univox Community spokespersons, and their views do not necessarily reflect those of Univox Community.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.



Confidentiality of surveys

Univox Community's clients may disclose confidential and/or proprietary information and materials to you as part of Surveys, and such information and materials shall remain the sole and exclusive property of its owner. This confidential information may include, but is not limited to, new product ideas or concepts, packaging concepts, advertising and movie or television concepts or trailers, and the text, visual images and sounds related thereto. By becoming a member, you agree that you will keep the contents and materials disclosed to you as part of all Surveys in which you participate confidential and not disclose them to any third party or use the confidential information for any purpose except for the sole purpose of completing the Survey. If you breach this obligation, in addition to forfeiture of your points and termination of your account, you may be liable for monetary damages to Univox Community and/or our client for damages caused by the result of your breach.



Materials provided to univox community or posted at any univox community web site

Univox Community does not claim ownership of the materials you provide to Univox Community (including feedback and suggestions) or post, upload, input or submit to any Univox Community Web Site or its associated services (collectively "Submissions").
